Welcome to Substy, a service operated by SAS DIGA. By accessing our platform, you agree to comply with these Terms of Service ("ToS"). If you do not accept these terms, please do not use our services.
1. Definitions
"We", "Our", "Us": Refers to SAS DIGA, operator of Substy.
"Service": Refers to the Substy platform and all its available features.
"User": Refers to any person or entity using the Service, including Models and Agencies.
"Account": Refers to the User’s personal space on the platform.
"Credits": Virtual currency usable within the Service.
2. Purpose of the ToS
These ToS define the terms of use of Substy, including the rights and obligations of Users and the limitations of liability for SAS DIGA.
3. Access to the Service and Account Creation
Access to Substy is reserved for individuals aged 18 or older.
Creating an account requires providing accurate and complete information.
The User is responsible for maintaining the confidentiality of their login credentials.
We reserve the right to suspend or terminate accounts found to contain false or misleading information.
4. Service Availability & Maintenance
We do not sell your data. However, we may share it with:
We aim to provide 99.9% uptime but do not guarantee uninterrupted access.
Maintenance updates may occasionally cause temporary downtime.
We are not liable for losses due to service interruptions or unforeseen technical issues.
5. Payment Terms and Refund Policy
Subscription: Users can subscribe to a monthly plan paid via DodoPayments.
Credits: Purchase of credits usable on the platform via DodoPayments or cryptocurrencies.
Refunds: A 14-day withdrawal period applies to subscriptions except credits. After this period, no refunds will be granted.
Auto-Renewal: Subscriptions renew automatically unless canceled before the next billing cycle.
Cancellation: Users can cancel their subscription at any time; no prorated refunds are provided.
6. User Rights and Obligations
Users agree to:
Comply with applicable laws and third-party rights.
Not use the Service for fraudulent or illegal purposes.
Not share or sell their account.
Not attempt to access other Users’ data or unauthorized sections of the Service.
Maintain the security of their account by using strong passwords and enabling two-factor authentication (2FA) when available.
We reserve the right to suspend or terminate an account in case of a breach of these rules.
7. Content Management and Intellectual Property
User Content: Users retain ownership of their content posted on the platform.
License: By posting content on Substy, the User grants SAS DIGA a non-exclusive, global, royalty-free license to use, display, and distribute this content within the scope of the Service’s operations.
Platform Ownership: All elements of the Service (software, interface, design, etc.) remain the exclusive property of SAS DIGA.
Third-Party Content: Users must ensure that they have the right to upload any content and that it does not infringe on third-party rights.
8. Termination
Users can cancel their subscription at any time through their account settings.
Deleting an account results in the loss of access to data and remaining credits.
SAS DIGA reserves the right to suspend or delete an account in case of non-compliance with the ToS.
We reserve the right to terminate accounts due to prolonged inactivity (e.g., more than 12 months without login).
9. Security Measures
SAS DIGA implements security protocols including encryption, firewalls, and routine security audits.
Users are responsible for keeping their login credentials secure.
Any suspicious activity should be reported immediately to support@substy.ai.
10. Limitation of Liability
SAS DIGA cannot be held liable for:
Temporary interruptions of the Service.
Data loss resulting from the use of the Service.
Actions taken by Users on the platform.
Unauthorized access to user accounts due to negligence in maintaining security measures.
11. Third-Party Integrations & APIs
SAS DIGA cannot be held liable for:
The Service may integrate with third-party applications (e.g., payment processors, AI tools, analytics services).
SAS DIGA is not responsible for failures or security issues caused by third-party integrations.
Users are responsible for complying with the terms of third-party services.
12 Dispute Resolution and Applicable Law
Governing Law: These ToS are governed by French law.
Amicable Resolution: In case of a dispute, the User agrees to contact SAS DIGA before taking legal action.
Jurisdiction: Any dispute shall be subject to the exclusive jurisdiction of the courts of Bordeaux, France.
Binding Arbitration: If an amicable resolution fails, disputes may be resolved through arbitration before legal action.
13 Limitation of Liability Regarding Private Platforms
Substy may integrate automated tools or software interacting with accounts on third-party private platforms. SAS DIGA shall not be held responsible for any errors, malfunctions, or unintended actions caused by such software on users' accounts on these private platforms. The user acknowledges and accepts that they use these integrations at their own risk and are responsible for verifying and supervising all automated actions performed on their third-party accounts.
14 Content Moderation
To maintain a safe, respectful, and lawful environment, Substy strictly adheres to the following content moderation guidelines:
1. No In-Person Meetings:
Substy must never facilitate, encourage, or suggest real-life meetings or interactions between users.
Always redirect conversations to remain virtual.
2. Prohibited Language and Themes:
Conversations involving explicit references to bodily waste (e.g., pee, urine, feces, shit) are strictly prohibited.
Immediately redirect or terminate any interactions involving such terms or requests.
3. Zoophilia and Animal-related Roleplay:
Any form of zoophilia, animal abuse, or animal-related sexual content or roleplay is strictly forbidden.
Substy must promptly disengage and report such requests.
4. Incestuous and Underage Content:
Absolutely no roleplay or conversations that suggest father-daughter dynamics or any incestuous relationship.
Any content implying minors or referencing underage individuals in a sexual context is strictly forbidden and must result in immediate termination and reporting.
5. Slavery and Non-Consensual Roleplay:
Any request, implication, or engagement in slavery-themed content, non-consensual scenarios, or coercive situations is strictly prohibited.
Conversations must always maintain consensual themes and mutual respect.
6. Compliance with Platform Guidelines:
Substy agrees to fully comply with the guidelines, terms, and conditions of any private platforms where it operates.
Users must also adhere to the specific rules and guidelines established by the private platform.
7. Enforcement:
Substy reserves the right to immediately terminate and log conversations that breach any part of this policy.
Repeated violations may result in permanent bans from interacting with Substy.
15 Changes to the ToS
SAS DIGA reserves the right to modify these ToS at any time. Users will be informed via email or notifications on the platform. Continued use of the Service after modification constitutes acceptance of the new ToS.
